Members may request and obtain, while respecting privacy as protected by law, copies of documents or information, within two months preceding the annual general meeting for any document relating to the latter; between two general meetings and at the latest two months before the next one, in the case of documents prepared or received by the company.

Article L.326-5 of the French Intellectual Property Code

« The conditions under which the members of collective management bodies may obtain, while respecting secrets protected by law, copies of documents or information, including personal information, relating to the meeting or the financial year in progress, within a period fixed by the articles of association or the general regulations which may not be less than two months before the general meeting mentioned in Article L. 323-5 [annual general meeting], are fixed by decree of the French Council of State. »

Article R.321-17 of the French Intellectual Property Code

« During the intervals between two general meetings, and at least two months before the next meeting, any member of the collective management body shall be entitled to consult any document drawn up by that body or received by it concerning the financial year in progress, subject to compliance with respect for secrets protected by law. The member sends the organisation a written request indicating the documents which they wish to access. Within a period of ten days from receipt of the request, the organisation shall transmit the documents or, if this transmission is not physically possible, propose a date for exercising the right of access which shall then take place at the registered office or the location of the administrative department of the collective management organisation, under the conditions defined by the articles of association. In exercising this right, the member may be assisted by any person of his or her choice. »

Article R.321-18 of the French Intellectual Property Code

« Any member of a collective management body may also, within the time limit set in Article L.326-5, ask the body to send him or her:
1- The annual financial statements that will be submitted at the general meeting;
2- The reports from the management, administrative and management bodies and the statutory auditors that will be submitted at the meeting;
3- Where applicable, the text and explanatory statements for the proposed resolutions, as well as information concerning candidates for corporate office or an elected position.
The documents referred to in 1° to 3° are, during the same period, available to members at the registered office or in the location of the administrative department of the collective management body, where they may familiarise themselves with them and obtain a copy thereof. The organisation is not required to respond to requests for documents that it makes available to its members on its site. »

Article R.321-19 of the French Intellectual Property Code

« The organisation may not respond to repetitive or abusive requests. »

Article R.321-20 of the French Intellectual Property Code

« Any member who has a request for documents presented pursuant to Article L.326-5 refused may refer the matter to the supervisory body provided for in Article L.323-14. “The supervisory body shall issue a reasoned opinion on this refusal. This notice is sent to the requesting party and the legal representative of the organisation. »

Article L.323-13, Penultimate Paragraph

« [The individual declaration of interests required annually by members of the Board of Directors, members of the Supervisory Committee who are candidates or in the process of being appointed and the Chief Executive Officer] shall be made available to the members of the General Assembly for a period of two months before the annual meeting of said assembly at the registered office of the collective management body. The conditions of its consultation must ensure respect for privacy, the protection of personal data and business secrecy. »
