LaScam (Société civile des auteurs multimedia, à capital variable, 5 avenue Velasquez, 75008 Paris) has undertaken to ensure that collecting and processing your personal data comply with the General Data Protection Regulation of 27 April 2016 (GDPR) and the French Data Protection Act.

1. Purpose of the processing, personal data collected and retention

1. 1 You are a member or the successor of a member of LaScam or are in the process of joining

LaScam: LaScam processes your personal data for the purposes of:-

  • managing your rights (documentation, collection and distribution of royalties);
  • allocation of aid and various services requested (cultural, social, legal aid, etc.);
  • organising and managing meetings of the various LaScam bodies;
  • organising the society’s general meetings and in particular voting;
  • for use in surveys and studies.

The legal basis for such processing is your contractual relationship with LaScam and LaScam’s legal or statutory obligations. LaScam, as data controller within the meaning of the GDPR, limits the collection of personal data to those data that are adequate, relevant and necessary for the processing carried out by the society. LaScam informs you in the forms of the optional or mandatory nature of any data collected. These data include:-

  • information relating to your identity – title, surname, first name, pseudonym, date and place of birth;
  • your contact details – postal address, email address, telephone numbers, social networks, personal website, etc.;
  • your bank details enabling the payment of your rights or aid, prices and, where applicable, compensation or reimbursement of expenses;
  • your tax and social security data in the context of our legal and contractual obligations towards the administrations and bodies concerned; your identification and authentication data in your member area;
  • information you provide it by filling in forms or communicating with LaScam, by telephone, post or electronic mail or by any other means of communication.

Failure to provide the information requested by LaScam may result in it being impossible to manage your rights or process your requests. Your data must be accurate, complete and, if necessary, updated. LaScam may complete your data by itself (for example by recording your email address if you send it an email). You can update your data in your member area. Subject to legal obligations, in particular tax obligations, your personal data are retained in France, for the duration of the rights of exploitation provided for by the Intellectual Property Code. As an exception, these data may be retained for the duration of the applicable legal requirements, in order to allow claims or litigation to be processed.

1.2 Applying for or receiving LaScam aid or awards

LaScam processes your personal data for the purposes of:

  • allocating any aid and awards requested;
  • use in surveys and studies.

The legal basis for this processing is the legal, regulatory or statutory obligations of LaScam, which includes Article L. 324-17 of the French Intellectual Property Code (assistance with the creation and development of artistic and cultural education and artist training actions). In this context, in accordance with Article L. 326-2 of the French Intellectual Property Code, LaScam is required to update a single public electronic database (www.aidescreation.org), listing the names of the beneficiaries of such aid, the amount and use of the sums paid. LaScam, as data controller within the meaning of the GDPR, limits the collection of personal data to those data that are adequate, relevant and necessary for the processing carried out by the society. LaScam informs you in the forms of the optional or mandatory nature of any data collected. These data include:-

  • information relating to your identity – title, surname, first name, pseudonym, date and place of birth;
  • your contact details – postal address, email address, telephone numbers, social networks, personal website, etc.;
  • your bank details enabling the payment of aid or awards;
  • your tax and social security data in the context of our legal and contractual obligations towards the administrations and bodies concerned;
  • information you provide it by filling in forms or communicating with LaScam, by telephone, post or electronic mail or by any other means of communication.

Failure to provide the information requested in your application may result in it being impossible to process it. Your data must be accurate, complete and, if necessary, updated. LaScam may complete your data by itself (for example by recording your email address if you send it an email). Subject to legal obligations, in particular tax obligations, your personal data are retained in France for 10 years from the request. By way of exception, the necessary data may be retained for the duration of the applicable legal requirements in order to allow claims or litigation to be processed or, exceptionally, for longer periods in order to retain the history of the award.

1.3 You are a LaScam contact

LaScam processes your personal data for the purposes of:

  • responding to your requests;
  • organising and managing meetings or appointments.

The legal basis for such processing is your consent, which you may withdraw at any time. LaScam, as data controller within the meaning of the GDPR, limits the collection of personal data to those data that is adequate, relevant and necessary for the processing carried out by the society. LaScam informs you in the forms of the optional or mandatory nature of any data collected. These data include in particular:

  • information relating to your identity – title, surname, first name, pseudonym, date and place of birth;
  • your contact details – postal address, email address, telephone numbers, social networks, personal website, etc.;
  • information you provide it by filling in forms or communicating with LaScam, by telephone, post or electronic mail or by any other means of communication.

LaScam may complete or update your data by itself (for example by recording your email address if you send it an email).

1.4 You use the LaScam website

In so far as concerns access to the member area, refer to 1.1 above. Technical cookies may be used on the LaScam website to optimise your browsing and to collect statistics on visits.

1.5 Applying for a job at LaScam

LaScam processes your personal data in order to manage your application. The legal basis for such processing is the legitimate interest of LaScam, such that it may select appropriate candidates to join it. This interest does not prejudice the candidates’ own interests, since the processing is part of their job search. The data come either from direct contact with the candidate or via the recruitment agencies with which LaScam works. LaScam limits the collection of personal data to data that are adequate, relevant and necessary for the processing. These data include:-

  • information relating to your identity – title, surname, first name, pseudonym, date and place of birth;
  • your contact details – postal address, email address, telephone numbers, social networks, personal website, etc.;
  • your family situation;
  • your school course and career path;
  • your social and tax data in the context of our legal and contractual obligations towards the administrations and bodies concerned;
  • information you provide it by filling in forms or communicating with LaScam, by telephone, post or electronic mail or by any other means of communication.

The data collected during an application are necessary for LaScam to assess and process it. Failure to provide them will result in it being impossible to process the job application. Personal data are not transmitted to third parties or used in the context of LaScam’s activities or for the invitations or information referred to in point 2 below. Personal data are retained in France, for a maximum period of two years after the last contact that LaScam had with the candidate.


2. Information and invitations

LaScam informs you, through electronic or postal newsletters or specific mailings, of the services offered by LaScam and any events that may interest you (calls for applications, newsletters, invitations, etc.), on the basis of your consent, which you can withdraw at any time if you no longer wish to receive this type of information.


3. Data transmission

Your personal data are intended for LaScam’s various internal departments. They are sent outside LaScam when necessary for administrative management reasons or as a result of a legal or contractual obligation, to the following categories of recipients:- collective management bodies established within and outside the European Union with which LaScam has signed a representation agreement, international databases of authors or works, mutual societies, social security bodies, pension and provident organisations, partners and subcontractors.
Your data are not transferred to third parties. LaScam does not carry out any commercial exploitation of your personal data.


4. Conditions for transferring data outside the European Union

Certain personal data may be transferred, or accessible, outside the European Union, via LaScam partners and subcontractors. These transfers comply strictly with applicable regulations and are made either to a State with protection that is recognised as adequate by the European Commission, or under standard contractual clauses adopted by the European Commission, or under binding corporate rules.


5. Your Rights

You have the right to request access to your personal data and the rectification of any inaccurate data. You may request the deletion of the data and restriction of processing or object to processing, in the cases and within the limits as provided for by the applicable legislation. You also have the right to define guidelines relating to the retention, deletion and communication after your death of your personal data processed by LaScam, in accordance with applicable legislative and regulatory provisions.
If the processing is based on your consent, you can withdraw it at any time.


6. Security

LaScam implements appropriate technical and organisational measures to ensure the security and confidentiality of your data and to prevent any misuse or fraudulent use of the data.


7. Video Protection

LaScam has set up a video protection system on its premises, in its legitimate interest for the purpose of ensuring its security.
